These Terms and Conditions of Sale apply to all purchases made through karaca-alisveris.shop by consumers. By placing an order, the customer confirms that they have read and accepted these Terms and Conditions.

2. Products

The essential characteristics, descriptions, photographs and prices of the products are presented on the relevant product pages. We take reasonable care to ensure that this information is accurate. Images are provided for illustrative purposes, and minor variations in colour, packaging or appearance may occur without affecting the product’s essential characteristics.

Products are offered subject to availability. If a product becomes unavailable after an order is placed, we will notify the customer promptly and provide a full refund for the unavailable item using the original payment method.

3. Prices

Prices are displayed in the currency shown on the website, normally pounds sterling (GBP), and include any applicable sales tax or VAT unless expressly stated otherwise. Delivery charges are not included in the product price unless the product page specifically states that delivery is free.

Delivery charges and the total amount payable are displayed before the customer confirms the order. For deliveries outside the United Kingdom, customs duties, import taxes or local handling charges may be imposed by the destination country. Unless expressly included at checkout, these charges are the customer’s responsibility.

We may change our prices at any time. The price charged will be the price displayed when the order is submitted. If an obvious pricing or technical error occurs, we may cancel the affected order before dispatch and refund all amounts paid.

4. Orders

To place an order, the customer selects the desired products, reviews the shopping cart, provides accurate billing and delivery information, selects a delivery and payment method, and confirms payment. Before submitting the order, the customer may review and correct any input errors.

Submitting an order constitutes an offer to purchase. An automatic acknowledgement confirms that we have received the order but does not necessarily constitute acceptance. A binding sales contract is formed when we send a dispatch confirmation or otherwise expressly accept the order.

We may refuse or cancel an order where a product is unavailable, payment is declined, information supplied by the customer is incomplete or inaccurate, fraud or unauthorised activity is suspected, delivery cannot be made to the stated address, or an obvious pricing or description error has occurred. Any payment collected for a cancelled order will be refunded.

The customer must provide a valid email address, telephone number and complete delivery address. The customer is responsible for checking the order confirmation and informing us promptly of any error.

5. Payment

Payment must be made using one of the methods displayed at checkout. Depending on availability, accepted methods may include major debit and credit cards and other payment methods supported by Stripe.

Card and electronic payments are processed securely by Stripe or another payment service provider identified at checkout. Payment information is encrypted and handled in accordance with applicable payment security standards. We do not receive or store the customer’s complete card number or card security code.

By submitting payment details, the customer confirms that they are authorised to use the selected payment method and authorises the relevant payment provider to charge the total order amount. Additional authentication, including 3D Secure verification, may be required.

Payment may be authorised when the order is submitted and captured when the order is accepted or prepared for dispatch. If payment is refused or cannot be authenticated, the order will not be processed. Refunds are normally issued to the original payment method; processing times may vary depending on the bank or payment provider.

6. Delivery

Available delivery methods, charges and estimated delivery times are displayed at checkout. Unless otherwise indicated, orders are normally prepared within one to three business days. Standard delivery within the United Kingdom is generally expected within three to seven business days after dispatch. International delivery is generally expected within seven to fifteen business days after dispatch.

Delivery times are estimates unless a specific guaranteed delivery date has been expressly agreed. Delays may occur because of customs controls, carrier disruption, adverse weather, public holidays or other circumstances beyond our reasonable control.

The customer must ensure that the delivery address is complete and accurate. Additional costs resulting from an incorrect address, an unclaimed parcel or an unjustified refusal of delivery may be deducted from any refund where permitted by law.

Risk of loss or damage passes to the customer when the customer, or a person nominated by the customer other than the carrier, physically receives the goods. Ownership passes when full payment has been received and the goods have been delivered.

If delivery is materially delayed, the customer may contact us at [email protected]. Where the law permits cancellation because of late delivery, we will refund the affected order after cancellation.

7. Right of Withdrawal and Returns

A consumer purchasing at a distance generally has the right to cancel the contract within fourteen days without giving a reason. For goods, the withdrawal period expires fourteen days after the day on which the customer, or a person nominated by the customer other than the carrier, receives the goods. For an order containing multiple goods delivered separately, the period begins upon receipt of the final item.

To exercise the right of withdrawal, the customer must send an unambiguous cancellation notice before the withdrawal period expires. The notice may be sent by email to [email protected] or by post to ETEZEN LTD, Returns Department, 590 Rochester Way, London SE9 1RL, United Kingdom. The notice should include the customer’s name, order number, contact details, products concerned and date of receipt.

After notifying us, the customer must return the goods within fourteen days. Unless the goods are defective, incorrect or otherwise non-conforming, the direct cost of returning them is borne by the customer. The customer should use suitable protective packaging and retain proof of postage.

Returned goods may be inspected only to the extent necessary to establish their nature, characteristics and functioning, as would be permitted in a physical shop. We may reduce the refund to reflect any loss in value caused by handling beyond what is reasonably necessary.

We will refund the price paid for the returned goods and the cost of the least expensive standard delivery option offered at the time of purchase. Additional delivery costs resulting from the customer’s choice of an enhanced or express service are not refundable. Refunds will be made within fourteen days after we are informed of the withdrawal, but we may withhold the refund until we receive the returned goods or the customer provides evidence that they have been sent back.

The right of withdrawal does not apply where a legal exception applies, including goods made to the customer’s specifications or clearly personalised, sealed goods not suitable for return for health protection or hygiene reasons once unsealed, perishable goods, or sealed audio, video or software products once unsealed.

8. Defective, Damaged or Incorrect Products

The customer should inspect the order promptly after delivery. If a product is damaged, defective, incomplete or different from the product ordered, the customer should contact us as soon as reasonably possible at [email protected] and provide the order number, a description of the issue and, where helpful, photographs.

Where goods do not conform to the contract, the customer is entitled to the remedies provided by applicable consumer law. Depending on the circumstances, these may include repair, replacement, a price reduction or a refund. Where a return is required because the goods are defective, damaged or incorrect, we will provide reasonable return instructions and bear the necessary return costs.

9. Legal and Commercial Guarantees

All products benefit from the statutory rights and guarantees that cannot lawfully be excluded, including the requirement that goods be of satisfactory quality, fit for their usual or expressly agreed purpose, and as described.

Unless a longer manufacturer’s guarantee is stated on the product page, we provide a twelve-month commercial guarantee against manufacturing defects from the date of delivery. This commercial guarantee is provided in addition to, and does not limit or replace, the customer’s statutory rights.

The commercial guarantee does not cover normal wear and tear, accidental damage, misuse, improper installation, unauthorised repair or modification, failure to follow care instructions, cosmetic damage that does not affect normal use, or damage caused by external events.

To make a guarantee claim, the customer should contact [email protected] with proof of purchase and details of the issue. We may request photographs or the return of the product for inspection.

10. Complaints

Questions or complaints concerning an order, payment, delivery, return or product may be submitted to ETEZEN LTD by email at [email protected], by telephone at +44 59 48 74 15 22, or by post to 590 Rochester Way, London SE9 1RL, United Kingdom.

Customers should include their full name, order number, contact details and a clear description of the complaint. We aim to acknowledge complaints within two business days and provide a substantive response within fourteen business days.

If a complaint cannot be resolved directly, the customer may seek assistance from an appropriate consumer advice service, approved alternative dispute resolution provider or competent court. Participation in alternative dispute resolution will be considered where required by law or agreed between the parties.

11. Liability

Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory consumer rights, or any other liability that cannot lawfully be excluded or limited.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed, losses caused by inaccurate information supplied by the customer, or delays and failures resulting from events beyond our reasonable control. Products sold to consumers are intended for private use, and we are not liable for business losses, loss of profit or loss of commercial opportunity.

12. Personal Data

Personal data supplied in connection with an order is used to process payment, fulfil and deliver orders, provide customer service, prevent fraud and comply with legal obligations. Payment data is processed by Stripe or the payment provider selected at checkout. Further information about the collection and use of personal data is provided in the website’s Privacy Policy.

13. Force Majeure

We will not be liable for delay or failure to perform caused by circumstances beyond our reasonable control, including natural disasters, severe weather, epidemics, war, civil unrest, industrial disputes, transport interruption, customs delays, failures of telecommunications or payment networks, or government action. We will take reasonable steps to minimise the effects and resume performance as soon as practicable.

14. Severability and Changes

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in effect. A failure to enforce any provision does not constitute a waiver of that provision.

We may update these Terms and Conditions from time to time. The version applicable to an order is the version displayed and accepted when the order is submitted. Changes will not affect contracts already concluded unless required by law or agreed with the customer.

15. Applicable Law and Jurisdiction

These Terms and Conditions and all sales made through karaca-alisveris.shop are governed by the laws of England and Wales. The courts of England and Wales shall have jurisdiction, subject to any mandatory consumer protection rules that allow the customer to rely on the law of, or bring proceedings in, the country or region where the customer habitually resides.

Nothing in these Terms and Conditions restricts any mandatory rights granted to consumers under applicable local, national or international consumer protection law.
